Terms of Sale

1. Who is selling

These terms apply to every purchase made in the Tenuta Montevitolo shop, on the website or in the app.

2. Products and prices

Each product page describes the product as faithfully as possible; photos are for illustration. Prices are in euro and include VAT. The price shown on the product page at the time of the order applies. Delivery costs are shown separately, at checkout, before payment.

The sale of wine, sparkling wine and other alcoholic drinks is reserved to adults: by ordering them you declare that you are at least 18 years old.

3. Order and payment

You choose the products, enter the delivery details and, if needed, the billing details, and pay at checkout. The contract is concluded when you receive our confirmation email, which summarises the order.

Accepted payment methods:

• Bank transfer: we email you the bank details and ship once the payment has been credited.

4. Delivery

We deliver in Italy, unless otherwise indicated at checkout.

• Standard: €10, delivery in 3–5 working days. Free for orders of €60 or more (value of the products).
• Express: €20, delivery in 1–2 working days.
• Islands: surcharge of €4.

We also ship abroad, on request: write to us at bottega@tenutamontevitolo.it and, before you order, we will tell you the costs and times for your country.

Delivery times are indicative. When the parcel leaves we write to you, with the code to track it. On delivery, check the packaging: if it is damaged, report it to the courier and write to us straight away, with a photo.

Event tickets and gift cards are not shipped: they arrive by email.

5. Right of withdrawal

If you buy as a consumer (that is, not for your professional activity), you may withdraw from the contract within 14 days without giving any reason, as provided by the Italian Consumer Code (art. 52 et seq.). The 14 days run from the day you receive the products.

How to return a product:

• Ask for the return within 14 days of delivery by contacting customer service: write to bottega@tenutamontevitolo.it or call +39 329 449 4120, with the order number and the products you wish to return. An explicit statement is enough: if you prefer, you may use the model withdrawal form provided by the Consumer Code, but it is not compulsory.
• We send you the return label, with instructions for handing the parcel to the courier. Send the products back to us, well packed, within 14 days of your request.
• We refund you with the same payment method used for the order, including standard delivery costs: normally within 5 days of the products coming back, and in any case within 14 days of the day we receive the withdrawal request. We may wait for the products to come back, or for proof that you have sent them, before refunding.

If you chose express delivery, the difference compared with standard delivery is not refunded. You are liable only for any loss in value of the products resulting from handling other than what is necessary to establish their nature and characteristics.

6. When withdrawal does not apply

In the cases set out in art. 59 of the Consumer Code the right of withdrawal is excluded. For our shop this applies, for example, to:

• sealed bottles and packages which, for hygiene or health protection reasons, are not suitable for return, if they have been opened after delivery;
• any food products that are liable to deteriorate or expire rapidly;
• tickets for events taking place on a set date.

The legal guarantee for defective or non-conforming products always remains valid (point 8).

7. Gift cards

The gift card arrives by email, with its code, and is valid for 12 months from purchase. To use it, enter the code in the Customer area: the credit is spent at checkout, also over several purchases, until it runs out.

8. Legal guarantee

For products bought as a consumer, the legal guarantee of conformity provided by the Consumer Code (art. 128 et seq.) applies. If a product arrives damaged, defective or different from the one ordered, write to us at bottega@tenutamontevitolo.it with the order number and a photo: we will agree with you a replacement or a refund, at no cost to you.

9. Applicable law and jurisdiction

These terms are governed by Italian law. For disputes with a consumer, the court of the place where the consumer resides or is domiciled has jurisdiction (Consumer Code, art. 66-bis). Any rules more favourable to the consumer provided by law remain unaffected.
